Jefferson Healthcare settles lawsuit over Meta Pixel patient data sharing

The Washington-based provider will stop using Meta Pixel for at least two years and offer privacy tool subscriptions as part of the settlement.

 

What happened

Jefferson Healthcare has agreed to settle a class action lawsuit alleging it improperly shared patient data with third parties through tracking technologies, like Meta Pixel. The case, Jane Doe et al. v. Jefferson County Public Hospital District No. 2, was filed in March 2024, claiming that the hospital embedded code, including Meta Pixel, on its website between March 2020 and March 2024, which resulted in patient data being sent to companies such as Facebook and Google without patient consent.

Although the initial motion to dismiss the case was granted by a Washington Superior Court, the plaintiffs appealed. A settlement was eventually reached to avoid further litigation. The settlement received preliminary court approval and offers class members a 12-month subscription to CyEx Privacy Shield.

The lawsuit raised concerns about the use of website tracking technologies on healthcare platforms and the possible transmission of protected health information (PHI) to third parties without explicit consent. Jefferson Healthcare, which serves eastern Jefferson County in Washington, denies wrongdoing but has agreed to halt the use of Meta Pixel for at least two years, unless its use becomes legally compliant and is disclosed clearly in the website’s privacy policy.

In addition to the subscription vouchers, Jefferson Healthcare will pay $125,000 in attorneys’ fees, $2,500 to each class representative, and all settlement administration costs. Class members have until October 17, 2025, to exclude themselves or object. Voucher claims must be submitted by November 17, and a final approval hearing is scheduled for December 5.
